What does a Coroner do?

A coroner is an independent public official responsible for investigating certain deaths, particularly those that are sudden, unexplained, or occur under medical care. Their primary role is to determine the cause of death and whether it was due to natural causes.

A coroner will usually request a post-mortem examination to establish the cause of death. If the findings indicate that the death was due to unnatural causes, the coroner may hold an inquest to examine the circumstances.

The coroner essentially establishes the “who, when, where, and how” of an unexplained death. However, they do not assign blame or determine civil or criminal liability—only the facts.

When is a Death Reported to the Coroner?

Not all deaths require a coroner’s involvement, but they are typically notified when:

  • The death was sudden, unexplained, or unexpected.
  • The person died while undergoing medical treatment or surgery.
  • There are concerns about the standard of medical care provided.
  • The death occurred in unusual or suspicious circumstances.

Once a death is reported, the coroner will decide whether further investigation is necessary. This may involve obtaining medical records, speaking with healthcare professionals, or ordering a post-mortem examination.

An inquest is a formal legal inquiry into the cause of death. It is not about assigning blame but rather about establishing the facts. During an inquest, the coroner may hear evidence from doctors, medical experts, and other witnesses.

While an inquest does not determine civil or criminal liability, its findings can be significant in a potential medical negligence claim.

How Can the Coroner’s Findings Impact a Medical Negligence Claim?

The coroner’s investigation and inquest findings can provide crucial insights into whether medical errors contributed to a person’s death. If the inquest highlights failures in care, families may have grounds to pursue a medical negligence claim.

How the Coroner’s Process Impacts Obtaining a Death Certificate

  • If the post-mortem confirms that death was due to natural causes and no inquest is required, the coroner issues a certificate to the Registrar of Births and Deaths, who then registers the death and issues the death certificate.
  • If an inquest is necessary, the death is registered once the inquest concludes.
  • While waiting for the inquest or post-mortem report, families can request an Interim Certificate of the Fact of Death, which may be accepted by banks, insurance companies, and other institutions.
